Status Report Order
ORDER: The parties' stipulation 44 to a temporary restraining order to remain in place until the Court decides Plaintiff's motion for a preliminary injunction appears to exceed the 14-day time limit for a temporary restraining order set in Federal Rule of Civil Procedure 65(b)(2), as the proposed briefing schedule on Plaintiff's motion extends beyond that 14-day limit. The parties shall file a joint letter by 9/8/2026 clarifying whether they seek a stipulated temporary restraining order that, absent any extension allowed under Rule 65, will last for only 14 days; or a stipulated preliminary injunction to remain in effect until the Court rules on Plaintiff's motion. See In re Crawford, 329 F.3d 131, 13638 (2d Cir. 2003) (holding temporary restraining order that was to "remain in full force and effect until modified by further order, or until resolution of plaintiffs' motion for a preliminary injunction" was in effect a preliminary injunction). Depending on how they choose to proceed, the parties may, if necessary, propose a new briefing schedule. The Court will order a briefing schedule and schedule a hearing on Plaintiff's motion promptly after receiving the joint letter. So Ordered by Magistrate Judge Seth D. Eichenholtz on 9/4/2026. (DC)
