ORDER: On June 26, 2026, the court entered an order to show cause directed at non-party witness Matthew Lipscomb. (Doc. 40 ). That order required Lipscomb "to show cause why he should not be sanctioned for failing to follow the court's prior June 1 order and appear for his deposition." Lipscomb's deadline has passed, and he has not responded. So the court sets this case for a hearing on Plaintiff Townson's motion for sanctions. (See doc. 38 ). The hearing will take place on August 14, 2026, 1:00 PM, at the U.S. Courthouse, 1100 Gurnee Avenue, Anniston, AL 36201. The court ORDERS Lipscomb to appear at the hearing and explain why he has failed to attend court ordered depositions and respond to the court's order to show cause. Should Lipscomb fail to appear at the hearing, the court will enter a bench warrant for his arrest. Counsel for Townson should be prepared to argue Townsons motion for sanctions at the hearing.
