Bankruptcy Appeal (801) | Florida Southern
- Order (PAPERLESS or pdf attached) ~Util - Set/Reset Deadlines
PAPERLESS ORDER continuing abatement of this appeal and setting deadlines. The Court has reviewed Appellant's Status Report 29 , filed in compliance with the Court's prior Order 27 . As reported, the bankruptcy court has converted the underlying Chapter 11 cases to Chapter 7 but has not yet determined whether to vacate the order confirming the Chapter 11 plan, and Appellant represents that settlement discussions with the Chapter 7 Trustee may independently resolve this appeal. The Court thus finds good cause to maintain the temporary abatement. Accordingly, (1) this appeal shall remain ABATED; (2) the deadline for Appellant's Initial Brief and Appendix shall remain STAYED pending further order of the Court; (3) on or before July 22, 2026, Appellant shall file either (i) an updated status report advising the Court of the bankruptcy court's ruling on Appellant's motion to vacate the plan confirmation order [BR 518] and the status of settlement, and stating Appellant's position on whether this appeal is moot or should proceed, or (ii) a notice or stipulation of voluntary dismissal; and (3) if the appeal is not rendered moot or dismissed, Appellant's Initial Brief and Appendix shall be due on or before August 4, 2026. Signed by Judge Aileen M. Cannon on 6/26/2026. (jj02)
