ORDER finding as moot 14 Motion for Extension of Time to File. On June 4, 2026, the Court dismissed the 1 complaint in this action without prejudice for lack of subject matter jurisdiction. Plaintiff filed a 13 notice of appeal from that decision on June 17, 2026. Under Federal Rule of Appellate Procedure 4(a)(1), the notice of appeal "must be filed with the district clerk within 30 days after entry of the judgment or order appealed from." Therefore, the notice of appeal was timely filed in this case and no extension is necessary. The 14 motion for an extension is denied as moot. The Clerk of Court is directed to mail a copy of this Order to plaintiff at his address of record. Ordered by Judge Eric N. Vitaliano on 7/20/2026. (MVZ)
