MINUTE entry before the Honorable Steven C. Seeger: The Court reviewed Plaintiffs' status report (Dckt. No. 378 ), which says that attempts to "meaningfully confer with [Defendant] Kelliher have remained unsuccessful." Kelliher apparently hired an attorney, but communications with her have "not been meaningful in any way." This Court also reviewed Plaintiff's motion to dismiss the counterclaim for lack of prosecution. (Dckt. No. 379 ) A response is due by April 26, 2024. Kelliher's old lawyer (Adeena Weiss Ortiz) has reappeared on the scene and filed an appearance. She previously appeared in the case, but Judge Blakey granted a motion to withdraw in 2020. (Dckt. No. 242 ) Defendant Kelliher hasn't filed anything for years. Defendant Kelliher and his old/new counsel seek another 28 days to talk things over and file a joint statement. That motion for an extension of time (Dckt. No. 381 ) is denied. Kelliher has been out of touch, off the grid, and missing in action for quite some time. As this Court said on February 29, 2024, "Defendant Kelliher remains missing in action." (Dckt. No. 367 ) The case was filed in 2017, and it is now 2024. The Court sees no legitimate reason for more delay. Defendant Kelliher has had more than enough time to reemerge. This Court's "delay-tactic sensors" are going off. No more delays. The Court will preside over an in-person hearing on April 30, 2024 at 9:00 a.m. The Court will not allow telephonic appearances. Attorney Ortiz must appear. Defendant Kelliher must appear in person as well. A failure to comply will lead to appropriate relief, including the dismissal of claims or counterclaims, as well as the entry of judgment on claims or counterclaims, and other possible relief. The Court directs defense counsel to contact Defendant Kelliher, and notify him about the upcoming hearing and the duty to appear. The Court directs counsel to meet and confer no later than April 26, 2024. Counsel must discuss a potential resolution, as well as a path forward for the speedy completion of the case. If the parties have not resolved the case by the time of the hearing, then the parties must be ready for trial in the near future. The Court underscores the importance of compliance. Mailed notice.
