Minute Entry for proceedings held before Magistrate Judge Miroslav Lovric: an on the record Conference was held on 7/20/2026, via Teams teleconference. The Court addressed with the parties the disputes and issues as described in Status Reports 126, 127, 121, 110, 105, & 107. These disputes have been ongoing for many months. The Court heard from both sides. The Court is troubled and concerned as to Defendants and Non-Party DOCCS persistent delays and failure to meet discovery obligations and deadlines. Discovery delays caused by Defendants and Non-Party DOCCS in this matter are considerable and unwarranted. The Court intends to move this matter along expeditiously from hereon. Appearances: D. TEXT ORDER: Pursuant to the on the record conference held on 7/20/2026: (1) No later than 7/24/2026, Plaintiff is authorized to present to the Court a proposed subpoena to be endorsed by the Court and to be served on Non-Party DOCCS for production of discovery demands, and the deadline for DOCCS compliance and production shall be set as 8/17/2026; (2) No later than 8/3/2026, the parties shall file detailed status reports; (3) No later than 8/3/2026, Plaintiff is authorized to present to the Court proposed subpoenas to be endorsed by the Court and to be served on Non-Party DOCCS personnel for personal appearance of Non-Party DOCCS persons to appear for a Hearing on 8/31/2026 at 11:00 a.m., In Person, in Binghamton, New York; (4) No later than 8/10/2026, Defendants shall produce a Supplemental Privilege Log to Plaintiff; (5) No later than 8/24/2026, the parties shall file detailed status reports; (6) A Hearing is scheduled for 8/31/2026 at 11:00 a.m., In Person, in Binghamton, New York; and (7) At the 8/31/2026 Hearing, the Court will re-set the discovery deadline and dispositive motions filing deadline.
