MEMORANDUM OPINION AND ORDER. The respondents' motion to dismiss or, alternatively, for summary judgment, (Dkt. 7 ), is DENIED. Garcia-Espericueta's petition for writ of habeas corpus, (Dkt. 1 ), is GRANTED in part. The respondents are ORDERED to provide Garcia-Espericueta with an individualized bond hearing under 8 U.S.C. § 1226(a) within seven (7) days of the date of this Order or else immediately release him from custody. Until the bond hearing is held, the respondents are PROHIBITED from removing Garcia-Espericueta from, or transferring him outside of, the Southern District of Texas.
