TEXT ORDER: Status conference held. Defendant Jimenez's response to Plaintiff's discovery requests related to his phone are due no later than two weeks from the date of this Order. Counsel for Defendants are directed to meet and confer with non-party Joseph Appice regarding their subpoena in an effort to resolve any non-compliance. In the event that the meet and confers are unsuccessful, Defendants may file a motion to compel on 7/13/2026. The Court notes that, pursuant to Rule 37(a)(5), if the motion to compel is granted, or compliance is obtained after the motion is filed, the Court "must, after giving an opportunity to be heard, require the party... whose conduct necessitated the motion... to pay the movant's reasonable expenses incurred in making the motion, including attorney's fees" unless the motion was filed before good-faith meet and confer, the non-compliance was substantially justified, or the award would be unjust. Defense counsel are hereby ORDERED to provide a copy of this Order to Mr. Appice during their meet and confer process. On or before 6/25/2026, the parties shall file a joint letter regarding the disputes over geolocation data and the ESI searches. The letter shall be organized as follows for each dispute: (1) a brief, non-argumentative description of the dispute; (2) the position of the party seeking the discovery, with supporting legal authority; (3) the position of the party opposing the discovery request, with supporting legal authority. On that date the parties shall also file a joint proposed amended scheduling order. The parties shall continue to work cooperative to resolve or narrow any remaining disputes. The Court will hold the next status conference on 8/6/26 at 12:30 p.m. in Courtroom 9 of the Frank R. Lautenberg Post Office and U.S. Courthouse, 2 Federal Square, Newark, NJ 07102.
