   TEXT ORDER: In light of the District Judge's decision as to the State of New Jersey's motion to intervene at Dkt. No. 103 , no later than August 6, 2026, the State of New Jersey shall file its Answer to the Complaint. Should Plaintiffs wish to do so, no later than August 13, 2026, they shall either file their amended complaint on consent, or their motion formally requesting leave to amend. However, before filing any motion, Plaintiffs shall meet and confer with defendants to discuss whether defendants consent to the proposed amendment. Importantly, the Court reminds the parties of the liberal standard courts employ when analyzing motions to amend. Indeed, Rule 15(a)(2) expressly directs courts to "freely give leave" to amend "when justice so requires." Fed. R. Civ. P. 15 (a)(2). In addition, should defendants rest their opposition purely based on arguments of futility, courts may decline to engage in a detailed futility analysis at the early stages of litigation, especially considering that defendants may renew their arguments in a motion to dismiss following a plaintiff's amendment. Thus, in the interests of judicial economy and in the absence of undue prejudice, the Court may decline to engage in a detailed futility analysis where those arguments are better suited for consideration in a motion to dismiss. See Colombo v. Bd. of Educ. for the Clifton Sch. Dist., No. 11-cv-785, 2016 WL 6403081, at *2 (D.N.J. Oct. 27, 2016). The parties should be guided accordingly.. So Ordered by Magistrate Judge Jose R.
