Re: 337 , 339 , and 341 Motions to Seal. Amber Fairchild, Debra Karen King, Donald Kadson, Pixxels LLC, and Pixxels Limited have filed declarations in support of these motions to seal. Their reasoning for protecting the information at issue is that the Court previously found it to be commercially sensitive and granted prior motions to seal.
This reasoning is just sufficient enough to constitute compelling reasons to seal the information at issue here. The Pixxels entities, which entities the sealed information concerns, still dispute that they are proper parties to this action. And the Court initially granted the motions to seal the competitively sensitive information at issue because Pixxels was a third party at the time and claimed that the allegations New U made about it could harm its business. The Court thus GRANTS the motions to seal (ECF Nos. 337 , 339 , and 341 ). The documents filed under seal at ECF Nos. 335 , 337 , 339 , and 341 shall remain sealed.
However, the Pixxels entities have been named in this action since 2022. And should they remain as parties to the action after their motions to dismiss, the reasoning on which the Court based prior orders to seal will no longer be relevant. As a result, should the parties seek to seal the information at issue in the future, they may not refer back to their prior reasoning or the Court's prior rulings.
