ELECTRONIC ORDER:
Before the Court is Plaintiff Southwest Airlines Pilots Association's Amended Request to File Out of Time (the "Amended Motion") (Doc. No. 120), which expressly amends Plaintiff's previously filed Emergency Request to File Out of Time (Doc. No. 117). Plaintiff filed its Brief in Opposition to Defendant's Motion for Summary Judgment (Doc. No. 118) and Appendix in Support of its Brief in Opposition to Defendant's Motion for Summary Judgment (Doc. No. 119) shortly after its June 26, 2026, deadline to respond to Defendant Southwest Airlines Co.'s Motion for Summary Judgment (Doc. No. 102). Plaintiff therefore requests the Court's leave to file these documents past the deadline. Doc. No. 120 at 1. The Amended Motion states that Defendant is opposed to the requested relief. Id. at 3. However, after further conversation over the phone with counsel-of-record for both Plaintiff and Defendant, Defendant has now withdrawn its opposition to the Amended Motion and is unopposed to the relief requested therein. Further, Plaintiff's original Emergency Request to File Out of Time (Doc. No. 117) was filed prior to the June 26, 2026, deadline.
Having carefully considered the Amended Motion and the foregoing, the Court finds good cause for Plaintiff's requested relief. See Fed. R. Civ. P. 6(b)(1)(A) (court may extend time for good cause shown "with or without motion" if request is made before expiration of deadline). Accordingly, the Court GRANTS the Amended Motion. Plaintiff's Brief in Opposition to Defendant's Motion for Summary Judgment (Doc. No. 118) and Appendix in Support of its Brief in Opposition to Defendant's Motion for Summary Judgment (Doc. No. 119) are hereby deemed timely.
As a result of the Court's ruling herein, Plaintiff's original Emergency Request to File Out of Time (Doc. No. 117) is MOOT.
