Order on Motion to Request Mediation Status Report Order
ORDER denying 174 Motion to Request Mediation. Defendant/Second Third-Party Plaintiff Foreview Contracting (Foreview) requests "that the Court issue an order referring this matter to mediation before a private (non-panel) mediator, with or without the consent of the parties." See ECF No. 174 at 1. Foreview asserts that "referral to a mutually agreeable private mediator with relevant subject-matter experience will best facilitate a productive, efficient resolution of the parties' claims." Id. Plaintiff's letter at ECF No. 175 indicates Plaintiff is amenable to mediation.
The Court will not refer parties to participate in non-panel mediation. They are free to participate voluntarily in such mediation. The settlement-related options from the Court are a referral to Court-annexed mediation or a settlement conference with the Magistrate Judge. Counsel are on notice that there is likely to be greater scheduling flexibility with the Court-annexed mediation than with the Court's schedule. For any Court mediation, the parties (and if applicable, their insurance carriers) will be expected to participate. On or before 9/18/2026, all appearing parties are to submit a joint letter stating their interest in a referral to Court-annexed mediation; their interest in a settlement conference with a Magistrate Judge; and counsel and their clients' availability for a settlement conference on October 22, 27, 28, or 29th in person. The parties and counsel are informed that although the Court will endeavor to accommodate their schedules, they may be required to appear on a date of the Court's choosing.
