ORDER GRANTING DEFENDANTS LEAVE TO FILE MOTION TO RESOLVE FUNDAMENTAL DISPUTE REGARDING SCOPE OF CLAIMS ASSERTED IN COMPLAINT AND STRIKE PORTIONS OF PROPOSED PRETRIAL CONFERENCE ORDER (ECF no.156) by Judge Otis D. Wright, II: 1. Defendants' Application is GRANTED. 2. Defendants are hereby granted leave to file their Motion to Resolve Fundamental Dispute Regarding Scope of Claims Asserted in Complaint and Strike Portions of Proposed Pretrial Conference Order (the "Motion"), a copy of which is attached to the Declaration of Levi Y. Silver as Exhibits A through D. 3. Within five (5) calendar days of the date of this Order, Defendants SHALL FILE the Motion as a separate document entry in the Courts CM/ECF System. 4. Within seven (7) calendar days from the date Defendants file the Motion pursuant to paragraph three, Plaintiffs shall file an opposition. 5. Within seven (7) calendar days from the date Plaintiffs file an opposition pursuant to paragraph four, Defendants may file a reply. 6. No hearing will be held. The Court will resolve the Motion on the papers, unless otherwise ordered. If the Court determines a hearing is warranted, it will notify the parties. (lc)
