ORDER: For the reasons stated in the Court's Minute Order of December 3, 2020, it is hereby ORDERED that judgment is entered in Defendant's favor as set forth in the Court's August 9, 2019 Memorandum Opinion and Order. See Hale v. United States, No. 13-1390, 2019 WL 3767115, at *9 (D.D.C. Aug. 9, 2019); see also; Dkt. 100 at 20-21. The Clerk of the Court is hereby directed to terminate the case. MINUTE ORDER: In its Memorandum Opinion and Order of August 9, 2019, "the Court [found] that Plaintiff is barred from recovery because he was contributorily negligent," but "defer[red] the entry of judgment, pending a joint status report from the parties informing the Court how they would like to proceed regarding the settlement issue" in the case. Hale v. United States, No. 13-1390, 2019 WL 3767115, at *9 (D.D.C. Aug. 9, 2019); see also Dkt. 100 at 20-21. On November 10, 2020, Defendant filed a joint status report informing the Court "that the [p]arties have resolved the settlement issue [and that Defendant] respectfully requests that the Court enter judgment in [its] favor." Dkt. 125 at 1. The status report noted that "Plaintiff d[id] not oppose [Defendant's] request." Id.
In light of the parties' joint status report, the Court will order that judgment be entered in Defendant's favor as set forth in the Court's August 9, 2019 Memorandum Opinion and Order. See Hale, 2019 WL 3767115, at *9; Dkt. 100 at 20-21. A separate order will issue. Signed by Judge Randolph D. Moss on 12/3/2020.
