TEXT ORDER: In light of Docket Entry 97 and the impending trial, the Court has reviewed Defendants' submission at Docket Entry 101 . The submission reflects that Defendants made the request required by Docket Entry 97 and that Hyundai Transys declined to provide the DFMEA's contents or data because it treats that material as a trade secret. (DE 101 -2 at 24.) The present record does not establish that Defendants possess the DFMEA or have authority to compel Hyundai Transys to produce it. The submission nevertheless indicates that the applicable supplier agreement requires Hyundai Transys to provide certain information confirming compliance with Kia's specifications and to certify completion of a DFMEA. (DE 101 at 2, para 89.) Hyundai Transys's response does not address whether Defendants possess or may obtain any DFMEA certification, compliance confirmation, testing result, summary, communication, or related supporting record. To permit resolution of that narrower issue before trial, Defendants shall, no later than 12:00 p.m. on Monday, July 13, 2026:1. file a supplemental sworn declaration stating whether Defendants possess any DFMEA certification, compliance confirmation, test result, summary, communication, or related record concerning the subject seating system and confirming that all such materials have been produced; 2. state whether the supplier agreement gives Defendants any present contractual right to obtain the DFMEA or any related certification, summary, testing material, compliance record, or supporting documentation; 3. confirm that Defendants have conducted a reasonable search of the files of personnel responsible for the design, procurement, validation, approval, and release of the subject seating system; and 4. submit for in camera review the pertinent provisions of the supplier agreement bearing on those issues.Plaintiff shall file, no later than 5:00 p.m. on Monday, July 13, 2026, a notice identifying the specific trial relief, if any, she seeks in light of Docket Entry 101. The Court will address the matter before opening statements. No additional discovery is authorized absent further order.
