ORDER: Plaintiff has not complied with the Court's Orders dated July 26, 2024 and August 7, 2024. Plaintiff was notified that failure to respond to the Court's August 7, 2024 Order by August 15, 2024 might result in this case being dismissed for failure to prosecute. Additionally, plaintiff was notified on August 2,2024 that defendants sought an Order to Show Cause why the case should not be dismissed for failure to prosecute. Indeed, plaintiff has taken no substantive action to prosecute either action 24-cv-285 or action 24-cv-2783 since removal to this Court in January 2024 and April 2024, respectively. Because plaintiff has not responded to either the July 26 or August 7 Order, or otherwise indicated an intent to pursue this action, this action is dismissed for failure to prosecute pursuant to Federal Rule of Civil Procedure 41(b). See Hunter v. New York State Dept. of Correctional Servs., 515 F.Appx 40, 43 (2d Cir. 2013) (dismissal for failure to prosecute was proper where plaintiff was warned that inaction would result in dismissal, the district court maintained a busy calendar, and the plaintiffs delay was for a significant duration).
