Order on Motion to Stay
PAPERLESS ORDER. THIS CAUSE came before the Court upon the Parties' Unopposed Motion to Stay Deadlines. 64 . Therein, the Parties request that this matter be stayed pending the Court's resolution of Defendant's Motion for Summary Judgment 55 . See (ECF No. 64) at 1. The Parties argue that a ruling will directly implicate whether any claims may proceed to trial, so "proceeding to exert the necessary efforts and costs to prepare for trial, when the Court's ruling on Defendant's Motion may dispose of Plaintiff's claims, would neither serve the parties nor the efficient adjudication of this action." Id. at 2. The Court finds that a stay and removing this matter from the trial calendar is not necessary. However, the Court finds it is appropriate to briefly continue trial in this matter. Accordingly, UPON CONSIDERATION of the Parties' Unopposed Motion, the pertinent portions of the record, and being otherwise advised in the premises, it is hereby ORDERED AND ADJUDGED that the Motion 64 is GRANTED IN PART. Trial in this matter is hereby reset for the two-week trial period beginning December 14, 2026, at 9:00 AM in the Miami Division. The calendar call is reset for December 10, 2026, at 2:00 PM, while the final pretrial conference is reset for December 1, 2026, at 11:00 AM. The calendar call and the final pretrial conference will each also take place in the Miami Division. Signed by Judge K. Michael Moore on 9/3/2026. (hyn)
