Fifth-Party Defendants Bard, Rao & Athanas Consulting Engineers, P.C. a/k/aBR+A Engineers' ("BR+A") Motion to Dismiss and BR+A's and Mazzetti, Inc. s/h/a Mazzetti Inc. a/k/a Mazzetti+GBA's Motion for Summary Judgment and toDismiss are dismissed as moot. The Clerk of Court is directed to terminate themotions at ECF Nos. 282 and 311. The Clerk of Court is further directed toterminate the action.
