Minute Entry and Order: A telephonic status conference was held on 5/13/2024 before Magistrate Judge Taryn A. Merkl. Appearances by Aaron Schweitzer for Plaintiffs, Brian Jeffrey Shenker for Defendant The Dolar Shop Restaurant Group, LLC, and Thomas Hsien Chih Kung for Defendant Shanghai Shenzhuang The Dolar Shop Catering Management Co., Ltd. ("Shanghai Dolar Shop"). Discussion held regarding Defendants' motion to extend the dispositive motion deadline (ECF No. 134) and Defendants' intent to seek additional discovery. Counsel for Defendant Shanghai Dolar Shop clarified that they did not yet have the opportunity to complete depositions of Plaintiffs and that they are seeking six Plaintiff depositions, but anticipate that they can complete 2 depositions per day. The Court reluctantly grants the motion for the reasons discussed on the record, including that Shanghai Dolar Shop was added the case later than the original Defendants and because of the lack of clarity as to the discovery schedule given the tortured procedural history of this case. The parties agreed to hold the depositions no later than the week of 8/12/2024; the parties are directed to ascertain their availability for depositions immediately and to schedule the depositions for dates and times certain. The deadline to complete all discovery is 8/30/2024, and certification of the completion of all discovery shall be filed on ECF by 9/6/2024. The last date to take the first step in dispositive motion practice is 10/7/2024, and must be done in accordance with the Individual Rules of the assigned District Judge. There will be no further extensions to this schedule. As discussed on the record, the parties are strongly encouraged to discuss settlement and may request a referral to mediation or a settlement conference with the Court at any time. This must be done in parallel with the final discovery anticipated by the parties; engaging in settlement discussions and/or mediation will not be deemed good cause to further extend discovery.
