   TEXT ORDER granting 37 motion to be relieved as counsel. The withdrawing counsel served a copy of the motion on Defendant Ulster Hams, LLC by email and mail and informed it of the deadline for responding to the motion. [Doc. 37 at 2-3]; see Local Civil Rule 83.I.07 (D.S.C.). A limited liability company is an artificial entity that cannot appear pro se and must be represented by counsel in court. See, e.g., Rowland v. Cal. Mens Colony, Unit II Mens Advisory Council, 506 U.S. 194, 20102 (1993) ("It has been the law for the better part of two centuries... that a corporation may appear in the federal courts only through licensed counsel.... [T]he rationale for that rule applies equally to all artificial entities."); Gilley v. Shoffner, 345 F. Supp. 2d 563, 566-67 (M.D.N.C. 2004) (holding that a limited liability company could not appear in federal court pro se). Accordingly, the Court stays this action to allow Defendant time to obtain new counsel admitted to the bar of this Court. Defendant shall obtain new counsel and have new counsel file a notice of appearance in this case by September 28, 2026. Defendant is hereby on notice that, if it does not obtain counsel within the time provided by this Order, its Answer may be stricken and it may be held in default pursuant to Local Civil Rule 83.I.07 (D.S.C.). Present counsel for Defendant shall (1) serve a copy of this Order on Defendant within seven days, and (2) file a certificate of service by the same date.
