MINUTE entry before the Honorable M. David Weisman: Magistrate Status hearing held. Discussion of issues impacting MI-BOX Holding Company's renewed motion for a temporary restraining order. ECF #310. The parties remain at issue as to relief that involves content controlled by third parties, most notably Google Business Profile and content therein. A telephone conference is set for 7/7/26 at 2:00 p.m. for the Court and the parties to discuss the issues in contention, and attempt to resolve these issues without a hearing. Counsel should jointly provide preferred contact method and information to Courtroom Deputy Alyssia Owens. And to expedite any necessary hearing and ultimate resolution of the issues involved, a hearing is set for 7/20/26 at 2:00 p.m. to resolve any issues that remain after the 7/7/26 telephone conference. The parties will present evidence at the hearing by affidavit, stipulation and, if necessary to address confusion in the marketplace, live witnesses. By 7/13/26, the parties shall file a joint statement of stipulated facts as to the third-party usage issues; any supplemental briefing limited to 10 pages; and a Joint Status Report or other filing that reflects the parties' position on the need and method of presenting evidence as to continued confusion in the marketplace as it relates to the contested issues. The Court thanks counsel for their efforts at resolving these remaining issues.
