ORDER. On 7/23/26, the undersigned Magistrate Judge convened a telephone conference with counsel for the parties to discuss their request to have mediation of this case conducted by a Magistrate Judge. Given counsels' agreement that additional discovery would be beneficial before mediation occurs, as well as their joint assertion that discovery is being conducted, the Court suspends the current mediation deadline of 8/27/2026. The parties are instructed to submit a joint email status report to chambers for the undersigned no later than 9/15/26. The report is to indicate whether sufficient discovery has been completed for the parties to be prepared to mediate, indicate whether the parties prefer to conduct mediation before the undersigned Magistrate Judge or a private mediator, and if a private mediator is preferred, to indicate when that is scheduled to occur.
