STIPULATION AND ORDER TRANSFERRING ACTION TO THE NORTHERN DISTRICT OF CALIFORNIA PURSUANT TO 28 U.S.C. § 1404(a): NOW, THEREFORE, IT IS HEREBY STIPULATED AND AGREED, subject to the approval of the Court, that: 1. All parties consent to the transfer of this Action to the United States District Court for the Northern District of California, and this Action is transferred to that District pursuant to 28 U.S.C. § 1404(a). 2. Defendant waives any objection to venue in the Northern District of California as to this Action, including under Federal Rule of Civil Procedure 12(b)(3) and 28 U.S.C. § 1406(a), and will not seek to transfer the Action out of that District under 28 U.S.C. § 1404(a). 3. Defendants deadline to answer or otherwise respond to the Complaint is vacated. Defendant shall respond on the schedule set by the Northern District of California. 4. Except as stated in paragraph 2, nothing in this Stipulation waives any claim, defense, or objection of any party, including any defense under Federal Rule of Civil Procedure 12(b). The Clerk of Court is respectfully directed to transfer this case to the Northern District of California without delay and without regard to the otherwise applicable seven-day waiting period under Local Civil Rule 83.1.
