Order on Motion for Protective Order Order on Motion to Quash
TEXT ORDER. The Motion to Quash and/or for a Protective Order (ECF No. 1 ) of the subpoenaed party, Irine Schweitzer, LCSW, PsyD, is DENIED. The Court finds that Dr. Schweitzer appropriately sought judicial guidance before producing the subpoenaed records. On the merits, the Court finds that there is reasonable ground to believe the subpoenaed records are relevant to the underlying case in the Central District of California, Case No. 2:24-cv-05492-CBM, and that the need for the information clearly outweighs the privacy interests of the plaintiff, Kristi Marie Hoffman, in that action. The Court notes that Ms. Hoffman has placed her mental health directly at issue in the underlying litigation, has produced Dr. Schweitzer's December 31, 2025, treatment summary letter during discovery, and has identified therapy and medical records as documents she intends to rely upon in support of her claims. Accordingly, Dr. Schweitzer is ORDERED to produce the subpoenaed records within 21 days of this Order, subject to and in accordance with the Stipulated Protective Order in the underlying case, filed as ECF No. 76 in that matter.
