Re: 9 Joint Stipulated Discovery Plan and Scheduling Order
Having reviewed the parties' joint discovery plan and scheduling order (ECF No. 9 ), the Court finds that it fails to comply with the Local Rules for the below reasons.
Under LR 26-1(b)(1) discovery is measured 180 days from the date the first defendant answered or otherwise appeared. The parties measure the discovery cut-off date from the date of the FRCP 26(f) conference. The parties also indicate a discovery cut-off 240 days from this incorrect date, but they do not request special scheduling review.
To that end, since the parties are requesting longer deadlines than the ones specified in LR 26-1(b), the plan must state "SPECIAL SCHEDULING REVIEW REQUESTED" on its face. See LR 26-1(a). The parties do not make this indication on the face of their stipulation. Thus, the Court DENIES the parties' discovery plan and scheduling order (ECF No. 9 ).
