Order Dismissing/Closing Case or Party
PAPERLESS ORDER DISMISSING CASE WITHOUT PREJUDICE as to Defendant NCL Bahamas Ltd. THIS CAUSE is before the Court on Defendant NCL's joint 41 Notice of Settlement, filed August 12, 2026. Therein, NCL indicates that the Parties have reached a settlement and requests forty-five days to file dismissal papers. Accordingly, it is ORDERED AND ADJUDGED that this case is DISMISSED without prejudice as to NCL, NCL's 27 Motion to Dismiss is DENIED as MOOT, and this case remains open. Within forty-five days from the date of this Order and upon the filing of a stipulation of dismissal with prejudice or the filing of an appropriate joint motion and a fully-executed Settlement Agreement, the Court may amend this Order to dismiss the above-captioned action with prejudice, to approve the settlement if filed, and/or to retain jurisdiction over the Agreement, if filed. The Parties are advised that the Court does not retain jurisdiction over a settlement agreement without the Parties having filed the settlement agreement with the Court and, absent good cause, the Court does not review proposed settlement agreements for approval in camera. This entry constitutes the PAPERLESS ORDER in its entirety.. Signed by Judge Joan A. Lenard on 8/12/2026. (fbe)
