Order Dismissing Case
ORDER - For the reasons set forth in the accompanying Memorandum Opinion, it is hereby ORDERED that: Defendants Jeremiah Winters, Catherine Atwood, Jennifer Thompson, Abbey Sorensen, and Founders Grove Wealth Partners, LLC f/k/a Albero Advisors, LLC's (the "FGWP Defendants") Motion to Dismiss Salomon & Ludwin, LLC's ("S&L") First Amended Complaint, (ECF No. 90 ), is GRANTED. S&L's claims against these Defendants are DISMISSED WITHOUT PREJUDICE pursuant to the doctrine offorum non conveniens; Defendant Dynasty Financial Partners, LLC's ("Dynasty") Motion to Dismiss for Lack of Jurisdiction and Failure to State a Claim, (ECF No. 97 ), is GRANTED IN PART to the extent it asks the Court to decline supplemental jurisdiction. S&L' s claims against Dynasty are DISMISSED WITHOUT PREJUDICE pursuant to 28 U.S.C. § 1367(c)(3); The FGWP Defendants' Counterclaims, (ECF No. 115 ), are DISMISSED WITHOUT PREJUDICE; S&L's Motion to Dismiss the Counterclaims, (ECF No. 125 ), is DENIED AS MOOT; S&L's Motion to Strike the Individual Defendants' Jury Demand, (ECF No. 123 ), and S&L's Motion to Strike Immaterial, Impertinent, or Scandalous Matter in the Counterclaim, (ECF No. 127 ), are DENIED AS MOOT; S&L's Motion to Disqualify Counsel, (ECF No. 164 ), is DENIED AS MOOT; The FGWP Defendants' Motion to Seal, (ECF No. 167 ), is GRANTED. The portions of S&L' s Exhibit B identified in the Motion shall remain SEALED until further order of the Court; S&L's Motion to Seal, (ECF No. 173 ), is GRANTED. Exhibits E and F to S&L's Reply in Support of its Motion to Disqualify Counsel shall remain SEALED until further order of the Court; and, The Preliminary Injunction previously entered by the Court, (ECF No. 65 ), is DISSOLVED.
