ORDER: Ms. Connors filed a status report in 22-cv-4721 on April 19, 2024 43 in which she requests an extension of the discovery deadline until May 17, 2024. Ms. Connors's request is DENIED.
As an initial matter, Ms. Connors's request is denied on procedural grounds, as Ms. Connors does not file her request as a motion nor does she explicitly indicate whether Ms. Von Horn consents to her request.
Separate from the procedural deficiencies, Ms. Connors does not demonstrate good cause that would warrant an extension of the discovery deadline. Indeed, there have been multiple extensions of the discovery deadline in both cases. In 22-cv-4721, on August 22, 2023, the Court set a discovery deadline of March 1, 2024 and noted that "[e]xtensions are unlikely." On February 12, 2024, the Court granted a request to briefly extend discovery; discovery was thereby extended until March 22, 2024. The Court noted at the time that "[t]here shall be no further extensions of the discovery deadline absent truly extraordinary circumstances." On March 18, 2024, the Court reiterated that "[t]here shall be no further extensions of the discovery deadline absent truly extraordinary circumstances. The parties shall certify the close of all discovery on March 22, 2024." On March 21, 2024, following additional motion practice, the Court extended "the deadline for discovery until April 19, 2024. All discovery shall be completed by April 19, 2024. There will no further extensions of the discovery deadline."
The parties have been explicitly warned, across both cases, that discovery will not be extended. At bottom, Ms. Connors provides no sufficient basis to extend discovery through May 17, 2024, especially given the Courts prior warnings. Accordingly, discovery is certified as being closed. The final date to take the first step in dispositive motion practice, if any, shall be April 29, 2024. The parties are directed to comply with Judge Donnelly's rules regarding dispositive motion practice.
