ORDER TO SHOW CAUSE FOR PRELIMINARY INJUNCTION AND TEMPORARY RESTRAINING ORDER: ORDERED, that the above named defendant show cause before this Court on September 8, 2026 at 11a.m., why an order should not be issued pursuant to Rule 65 of the Federal Rules of Civil Procedure enjoining the defendant during the pendency of this action from terminating the plaintiffs' motor fuel franchises, including lease agreements and gasoline supply agreements, for the Sunoco branded retail gasoline stations at 314 Boston Post Road, Port Chester, New York 10753 and 555 North Broadway, White Plains, New York 10603. The hearing will be conducted by Webex Teleconference before Judge Roman. To access the teleconference: (1) dial 855-244-8681; (2) enter Access Code 2310 494 3855 #; and (3) press # again to enter the teleconference; and it is further ORDERED that Defendant shall electronically serve and file its opposition to Plaintiffs' motion for a temporary restraining order and preliminary injunction by September 8, 2026 at 10 a.m., and shall email a curtesy copy to Chambers; and it is further ORDERED that, sufficient reason having been shown therefore, pending the hearing of plaintiff's application for a preliminary injunction, pursuant to Rule 65, Fed. R. Civ. P., the defendant is temporarily restrained and enjoined from terminating the plaintiffs' motor fuel franchises, including lease agreements and gasoline supply agreements, for the Sunoco branded retail gasoline stations at 314 Boston Post Road, Port Chester, New York 10753 and 555 North Broadway, White Plains, New York 10603; and it is further ORDERED that security in the amount of $25,000 be posted by the plaintiff prior to 10 a.m. of September 8, 2026; and it is further ORDERED that service of a copy of this order and annexed papers upon the defendant's General Counsel, Ashley Bruman, Esq., at Sunoco LP, 8111 Westchester Drive, Suite 400, Dallas, Texas, by overnight certified mail and by email at ashley.bruman@sunoco.com on or before September 1, 2026, at 12 p.m., shall be deemed good and sufficient service thereof. Plaintiffs shall file proof of such service on the docket. Show Cause Hearing set for 9/8/2026 at 11:00 AM before Judge Nelson Stephen Roman. Show Cause Response due by 9/8/2026.
