Order on Motion for Extension of Time
ORDER. ExxonMobil Oil Corporation's request to extend the temporary restraining order and adjourn the temporary restraining order hearing, ECF No. 23, is GRANTED.
ExxonMobil represents that "[t]he parties in this matter have negotiated an agreement in principal to resolve this matter" and that, "with the consent of counsel for the Defendants," it requests that the Court extend the temporary restraining order and adjourn the hearing "in order for the parties to finalize a settlement agreement." Pl.'s Mot. for Extension of Time at 1, ECF No. 23.
Federal Rule of Civil Procedure 65(b)(2) provides that a temporary restraining order may be extended beyond the time otherwise permitted if "the adverse party consents to a longer extension" and requires that "[t]he reasons for an extension must be entered in the record." Fed. R. Civ. P. 65(b)(2). As the Second Circuit has explained, "[a] TRO cannot exceed fourteen days unless the district court, 'for good cause,' extends it for another period of no more than fourteen days; a TRO lasting longer than twenty-eight days requires that the adverse party consent." U.S. D.I.D. Corp. v. Windstream Commc'ns, Inc., 775 F.3d 128, 132 n.2 (2d Cir. 2014) (citing Fed. R. Civ. P. 65(b)(2)).
Accordingly, in light of Defendants' consent and the parties' ongoing efforts to finalize a settlement agreement, the temporary restraining order shall remain in full force and effect through August 18, 2026, unless earlier modified or dissolved by the Court.
The temporary restraining order hearing currently scheduled for July 16, 2026 at 9:00 a.m. is continued to August 18, 2026 at 11:00 a.m. in Courtroom Two, 141 Church Street, New Haven, Connecticut.
