Minutes of proceedings [non-document] before Judge Benita Y. Pearson. Telephonic Status Conference held on 8/5/2026. Present were Attorneys Christina C. Spallina and Robert J. Dubyak as counsel for Plaintiffs and the proposed Class; Attorneys Kimm A. Massengill-Bernardin and Michelle R. Evans as counsel for Plaintiffs Ohio Council 8, AFSCME, AFL-CIO; Local 2288, AFSCME, AFL-CIO; Local 2804, AFSCME, AFL-CIO; and United Nurses of America, Local 2026, AFSCME, AFL-CIO; Attorney Yelena G. Katz as counsel for Defendants; Attorney Baseer Tajudzin as party representative for Defendants; and, Katherine Harshman as party representative for the Union Plaintiffs. On 4/28/2026, Judge James S. Gwin conducted an in-person Mediation Conference at which the parties were able to reach an agreement in this matter. A discussion was had about the Settlement Agreement during the Status Conference. Counsel agreed that on or before 9/15/2026, the parties will file a Joint Motion for Order (1) Preliminarily Approving Settlement Agreement; (2) Approving Form and Manner of Notice to the Settlement Class; (3) Scheduling a Final Fairness Hearing for the Final Consideration and Approval of the Settlement Agreement; and (4) Finally Approving the Settlement. Counsel also agreed that on or before 9/15/2026, the parties will file a proposed Order Granting Preliminary Approval of the Settlement in which the court appoints interim class counsel, Orders interim class counsel to engage the Settlement Administrator to effect notice and implement the notice protocols, which require notice by a date certain and objections to be received no later than a subsequent date certain, Orders Defendants to file any notifications required under 28 U.S.C. § 1715 forthwith, and includes a proposed date for a fairness hearing.
