Order on Motion for Extension of Time Order on Motion for Leave to File Document
Judge Richard G. Stearns: ELECTRONIC ORDER entered granting 128 Motion for Extension of Time; finding as moot 140 Motion for Leave to File Document.
The parties are reminded that, under the current schedule, fact discovery must be completed by May 27 -- i.e., depositions may not occur after this date without leave of court. Because the parties have nonetheless allegedly agreed to hold several depositions after May 27, the court does not credit Autry's assertion that an extension will prejudice its interests. The court accordingly will allow the requested extension, despite its concerns about the diligence exerted by both parties.
Fact discovery closes 7/26/2024. Plaintiff shall designate expert(s) and serve Rule 26(a)(2) reports no later than 8/20/24; defendant's expert witness(es) will be designated and Rule 26(a)(2) reports filed no later than 9/17/24. Expert discovery must be completed by 10/8/24. Dispositive Motions (if any) are due by 10/29/24, with Oppositions due no later than 11/19/24; a Reply may be filed only with leave of court.
The parties are cautioned that the court is not inclined to further extension of these deadlines. (RGS, law3) -
