Order on Motion to Withdraw as Attorney
TEXT ORDER granting 85 Attorneys Bricker and Barnes's Motion to Withdraw as Counsel. Attorneys Lew R.C. Bricker and Michael D. Barnes, attorneys for Defendants Rex Express, Inc. and Rex Montesa, are now terminated from this case. At the 12/6/2023 telephonic hearing, the Court issued a Show Cause Order against Defendant Rex Montesa due to his failure to appear at the hearing, and the Court directed that failure to file a written response to the Show Cause Order could result in entry of a default judgment against him as well as Rex Express, Inc. No response to the Show Cause Order was filed by the deadline of 12/20/2023. Accordingly, the Court directs the Clerk to enter Defendant Rex Montesa's and Defendant Rex Express, Inc.'s defaults pursuant to Fed. R. Civ. P. 55(a). Finally, the undersigned recommends that default judgment be entered against Defendants Rex Montesa and Rex Express, Inc. due to their failure to appear at the 12/6/2023 hearing (see 11/28/2023 Text Order) and their failure to respond to the Show Cause Order, and the undersigned recommends that default judgment be entered against Defendant Rex Express, Inc. for the additional reason that it does not have corporate counsel.
