Order on Motion for Miscellaneous Relief
ORDER denying as moot 16 Motion to Require Plaintiff/Appellant to Pay Sanctions, Costs, and Attorney's Fees Assessed by Lower Courts. Plaintiff filed this action pro se. On October 12, 2017, the Court sua sponte dismissed the complaint for failure to state a claim, and Plaintiff thereafter appealed. (ECF Nos. 6-8.) On April 26, 2018, Defendants the Health Law Group and George Indest III filed a motion to require Plaintiff to "pay the sanctions, costs, and attorney's fees she was ordered to pay by the Courts below, before being allowed to proceed with her appeal." (ECF No. 16.) On June 7, 2018, the Second Circuit affirmed the dismissal of Plaintiff's case. No. 17-3362-cv (2d Cir. June 7, 2018). Accordingly, the motion is denied as moot, and the Clerk of Court is directed to terminate it. (ECF No. 16.) The Clerk of Court is directed to mail a copy of this order to Plaintiff, and note service on the docket. The Court certifies under 28 U.S.C. § 1915(a)(3) that any appeal from this order would not be taken in good faith, and therefore in forma pauperis status is denied for the purpose of an appeal.
