Order on Motion for Miscellaneous Relief
PAPERLESS ORDER DENYING without prejudice Plaintiff's 42 Motion to Allow Discovery in ERISA Action and for Production of the ERISA Administrative Record (the "Motion"). The instant Motion is premature because the scheduling order has not yet been entered and, therefore, the deadline for Defendant to produce the administrative record has not yet been established. See Gallo v. Prudential Ins. Co. of Am., No. 6:14-cv-556, 2014 WL 12620817, at *1 (M.D. Fla. Sept. 17, 2014) (denying the motion as premature because the defendant's deadline to produce the administrative record had not yet expired). Pursuant to Judge Williams' 35 Order of Referral and Setting Trial Date and Notice of Court Practice and Procedures (the "Order"), the Parties are required to have a scheduling conference and submit a joint proposed scheduling order, which will establish, among other deadlines, Defendant's deadline to produce the administrative record and the Parties' deadlines to address whether additional information beyond the administrative record is appropriate. Signed by Magistrate Judge Enjolique A. Lett on 8/20/2026. (dbl)
