MINUTE ORDER. On page 11 of their motion for default judgment, plaintiffs assert that in addition to the commercial activity exception of the Foreign Sovereign Immunities Act, this case falls within the non-commercial tort exception in 28 U.S.C. § 1605(a)(5). They state, "[c]ourts have applied this exception to maritime casualties and concealment where the defendant acts as a private party would," but no case citations follow. If plaintiffs are aware of authority to support the invocation of that exception, it is hereby ORDERED that they must provide citations to the relevant cases by September 30, 2026.
