ORDER BY MAGISTRATE JUDGE CHRISTINA T. SHAY: Given the expedited briefing schedule on attorney-client privilege where Plaintiff had limited time to respond to Defendants' two separate briefs, the Court requests that Plaintiff provide supplemental briefing with citations to the record and case law on the following topics: (1) the theory of Plaintiffs reliance for the Seventh and Eighth Causes of Action in the Fourth Amended Complaint, and the facts Plaintiff would rely upon in support of this theory; and (2) whether the Seventh and Eighth Causes of Action result in an implied waiver under Home Indem. Co. v. Lane Powell Moss and Miller, 43 F.3d 1322 (9th Cir. 1995). Plaintiff shall submit this brief, limited to 7 pages, on or before 6:00pm on September 4, 2026. The parties shall meet and confer on mutually agreeable times for the Court to hold a second hearing on Defendants' requests regarding attorney-client privilege (ECF 242 ) and on Plaintiff's Motion to Compel (ECF 173 ).
