PAPERLESS ORDER REQUIRING STATUS REPORT: This matter is before me upon a sua sponte review of the record following the Eleventh Circuit's issuance of its mandate on June 24, 2026, dismissing the appeal for lack of jurisdiction. See DE 53 . This case was removed from state court on March 18, 2025, and the parties thereafter filed various motions addressing, among other things, remand, defaults, and the sufficiency of the pleadings. On June 13, 2025, Plaintiff filed a notice of appeal, after which I subsequently denied the then-pending substantive motions without prejudice for lack of jurisdiction. See DE 37 . The Eleventh Circuit has now dismissed the appeal, concluding that the challenged rulings were not final. There has been no docket activity since issuance of the mandate over two months ago. In light of the issuance of the mandate and the current posture of the case, it is ORDERED AND ADJUDGED that, by or before Tuesday, September 22, 2026, the parties shall confer and file a joint status report addressing how this matter should proceed. The status report shall: (1) identify any claims, counterclaims, or crossclaims that remain pending before the Court; (2) advise whether any party intends to seek further relief and, if so, identify the anticipated motion or relief; (3) propose any appropriate deadlines or other case-management measures necessary to move this matter forward; and (4) advise the Court if the underlying dispute has been resolved, is no longer live, or otherwise does not require further judicial action. If so, the parties shall identify the appropriate filing necessary to close or otherwise dispose of this case. If the parties are unable to agree on a proposed course of action, they shall so indicate and separately identify their respective positions.
