MINUTE entry before the Honorable Maria Valdez: This case has been referred to Judge Valdez for discovery supervision and to conduct a settlement conference. The Court has reviewed the parties' recent joint status report 39 . The status report reflects that Defendant has agreed to produce additional policy documents, trainings, information about set-up and use of various computer systems, and performance metrics, among other items. Consistent with its agreement, Defendant shall produce such documents by 5/20/24. Defendant has also agreed to produce a sampling of certain data for putative class members. Defendant shall produce the sampling information by 6/28/24. Additionally, Defendant has agreed to perform a search of e-mails of certain designated custodians pursuant to agreed upon terms. To the extent necessary, the parties shall continue to meet and confer as to searches and custodians. Plaintiffs raise several issues. Plaintiffs assert that certain of Defendant's documents may have been altered and/or have missing sections. However, it appears that the parties have not yet fulsomely met and conferred on those topics, and Defendant represents that it is happy to look into any alleged discrepancies. The parties shall promptly meet and confer as to any alleged discrepancies. As to the other issues raised by Plaintiffs, they may ultimately file a motion to compel concerning native documents and the sampling size if they deem it appropriate to do so. However, Plaintiffs shall wait to file any such motion until after Defendant's productions are complete at the end of June. Similarly, Defendant may file a motion to compel regarding Plaintiffs' cell phone records if it ultimately deems it appropriate to do so. The parties are to file a joint status report by 7/2/24 detailing their discovery progress and the prospects of settlement. In the status report, the parties shall set forth an agreed proposed schedule for all remaining discovery. If the parties wish to begin the process of scheduling a settlement conference at any time prior to the status date, they may notify the Court. Mailed notice (lp, ) (Entered: 05/09/2024)
