TEXT ORDER re 145 , 147 , and 156 Motions to Seal. Before the Court are three unopposed motions to seal documents filed to support the motions for summary judgment, ECF No. 144, 146, and opposition thereto, ECF No. 155, because they contain confidential and/or proprietary information. ECF Nos. 145, 147, 156. The documents are judicial documents, and as such the presumption of public access applies. See Lugosch v. Pyramid Co. of Onondaga, 435 F.3d 110, 119 (2d Cir. 2006).
"In this instance, the parties have identified specific countervailing factors to overcome the presumption of public access due to the confidential and proprietary nature of the information." Xerox Corp. v. Conduit Glob., Inc., No. 6:21-CV-06467 EAW, 2025 WL 586244, at *4 (W.D.N.Y. Feb. 24, 2025); see also United States v. Sattar, 471 F. Supp. 2d 380, 387 (S.D.N.Y. 2006) ("[T]he presumption [of public access] can be overcome by sufficiently compelling countervailing interests.").
It is hereby ORDERED that the motion to seal filed by third-party defendant Ace American Insurance Company, ECF No. 145, and the motions to seal filed by defendants/third-party plaintiffs Independent Health Association, Inc., Independent Health Corp., DxID, LLC, and Elizabeth Gaffney, ECF Nos. 147 and 156, are PROVISIONALLY GRANTED pending the Court's decision on the motions for summary judgment.
