ORDER on Motions to Dismiss - Plaintiff Amalia Lucas asserts Indiana state tort claims (Claims I-III) and 42 U.S.C. § 1983 claims (Claim IV) on her own behalf and on behalf of her minor child, N.B.L. The DCS Defendants move to dismiss all Counts (ECF No. 55 .) Lucas, on behalf of herself and N.B.L., concedes to the dismissal of the state law claims, Counts I-III, against the DCS Defendants. The City Defendants move to dismiss Counts I and IV, the false imprisonment and section 1983 claims, the only claims pending against them. (ECF No. 60 .) Defendants did not violate a clearly established constitutional right and are thus entitled to qualified immunity. Defendants' Motions to Dismiss, (ECF Nos. 55 , 60 ) are granted.
