Minute Order Order on Motion for Partial Summary Judgment
MINUTE ORDER IN CHAMBERS of the Honorable Judge Jennifer A. Dorsey on 8/5/2026 denying 18 defendant's motion for summary judgment.
This is a premises liability case in which the plaintiff claims that he slipped and fell on a wet bathroom floor at an Albertson's grocery store. The plaintiff asserts a single claim captioned "Negligence--Premises Liability." The defendants move for summary judgment, arguing that there is no such thing as a "premises liability" claim under Nevada law because premises liability is merely a species of negligence and not an independent legal cause of action or independent tort, so "Plaintiff's claim for premises liability must be dismissed." ECF No. 18 at 2, 4.
The court denies the motion because the plaintiff has not pled a premises liability claim as an independent tort. The plaintiff has pled a single cause of action for negligence, clarifying in the claim's caption that the nature of that negligence claim is "premises liability." See ECF No. [1-3] at 8. Because the plaintiff has not pled separate claims for negligence and premises liability, but rather his complaint asserts a single negligence claim that specifically characterizes the type of negligence as premises liability, IT IS ORDERED that the defendant's motion for summary judgment 18 is DENIED. The hearing on that motion scheduled for this afternoon is VACATED as moot.
IT IS FURTHER ORDERED that this case is referred to the magistrate judge for a mandatory settlement conference. The parties' obligation to file their proposed joint pretrial order is stayed until 10 days after that settlement conference.
