Text Order 1 - Terminate Hearings
TEXT ORDER: On May 1, 2024, counsel for MMI and RDH notified the Court by letter that the Supreme Court had granted Defendants' certiorari petition. Defendants request a stay of the action pending the Supreme Court's decision. On May 3, 2024, Plaintiff's counsel responded by letter indicating that he consented to the stay, but "only upon two respectful requests of the Court." First, he asked that the Court order Defendants to comply with the deadlines for filing pretrial submissions. Second, he requests that Defendants be precluded from making any motions "up to the time of trial." Defendants responded by email challenging Plaintiff's requests. On May 6, 2024, Plaintiff submitted a reply letter by email.
Because the parties are in agreement that a stay is appropriate under the circumstances, the Court hereby STAYS this matter pending a decision by the Supreme Court. Within seven days of the Supreme Court's decision, Defendants shall file a letter notifying the Court of the decision. The upcoming pretrial conference (scheduled for 5/7/2024) and jury trial (scheduled to begin on 5/28/2024) are hereby ADJOURNED pending further order.
As to Plaintiff's requests for relief beyond consenting to the stay, Court declines to address those issues raised through informal letters and emails sent to the Court. Plaintiff may file a formal written motion, supported by appropriate briefing, setting forth the legal and factual basis for the requested relief. SO ORDERED. Signed by Hon.
