Order
ORDER On August 13, the Court adjourned the previously scheduled Initial Pretrial Conference to September 23, 2026, and ordered the parties to submit their proposed Case Management Plan and Scheduling Order by September 16, 2026. However, Defendant has not yet appeared, despite having been served on August 14, 2026, and he appears to be in default. The Court understands from Plaintiff's counsel that, although Defendant was lawfully served, counsel is continuing efforts to make contact with Defendant or identify his counsel. In light of those efforts, if Defendant has not appeared by September 30, 2026, on October 1, 2026, Plaintiff's counsel is ORDERED to advise the Court as to the status of any communication with Defendant or his counsel, and to propose next steps in this matter. The Initial Pretrial Conference scheduled for September 23, 2026 is ADJOURNED sine die. Counsel for Plaintiff is further ORDERED to serve Defendant's counsel, if known, with a copy of this order, either by email or first-class mail. (HEREBY ORDERED by Judge Margaret M. Garnett) (Text Only Order) (Garnett, Margaret)
