ORDER re 124 Motion Hearing. Following the suggestion of Plaintiff's counsel, the Court reached out to several attorneys who handle civil cases and who participated in another Civil RICO case. The undersigned's efforts were unsuccessful in identifying an attorney willing and available to take the case by way of direct appointment. Therefore, the court has no choice but to once again attempt to secure representation for Defendant Pena-Fernandez through a random appointment from the court's pro bono panel. The Clerk of Court is directed to randomly appoint counsel from the pro bono panel pursuant to 28 U.S.C. § 1915(e) and Local Rule 83L. Acknowledging the complexity of the case, the court expects that whoever is appointed will at a minimum review the case, meet with the defendant, and communicate with Plaintiffs' counsel.
