TEXT ORDER: Defendants' Brief in Support of Summary Judgment was timely filed. See Doc. 46 . The Daubert motion was not. Under Federal Rule of Civil Procedure 6(a)(1), when a time "period is stated in days or a longer unit of time," the "last day of the period" does not count if it falls on a legal holiday. For example, if the Court gave the parties 21 days after the close of discovery to file motions, this Rule would apply. But this Rule does "not apply when a fixed time to act is set." Advisory Committee's Note to 2009 Amendment of Rule 6(a). Because the Court set a 6/19 deadline, that is when Defendants' Daubert motion was due.
