Order on Motion to Amend/Correct
TEXT ORDER-- Plaintiff's motion for leave to file an amended complaint filed on August 14, 2026 (ECF No. 17 ) is DENIED without prejudice. Plaintiff failed to abide by this Court's February 20, 2026 Order and Judicial Preferences concerning the provision of a draft of the proposed amended pleading to Defendant's counsel in an effort to obtain consent to the amendment BEFORE filing the Motion. (ECF No. 14 ). Rather, Plaintiff's Counsel: (1) filed the Motion at 11:20 p.m. on the very last day permitted by this Court's June 26, 2026 Order (see ECF No. 16 ); and (2) improperly emailed Chambers separately on August 14, 2026 at 11:55 p.m. to explain that they "did not obtain defense counsel's consent to the amendment, as counsel was away and will not return until next week." Plaintiff shall follow the proper procedure for seeking leave to amend BEFORE re-filing the Motion. In the interests of justice, the deadline to request leave to file a motion to amend is extended to August 24, 2026, and will not be extended further absent exigent circumstances set forth in a letter FILED ON THE DOCKET. If Defendant declines to provide consent, then Plaintiff shall set forth in the renewed papers the date and time Defendant was contacted, what efforts were taken to procure consent, and when the rejection was received.
