ORDER that Defendants' Motion to Dismiss (Doc. 10 ) is granted as set forth in this Order. Plaintiff may file an amended pleading within 20 days of this Order. If Plaintiff fails to comply, the Clerk shall dismiss this matter for lack of subject matter jurisdiction. ORDERED Defendants' Motion to Quash Summons and Complaint and Motion to Dismiss for Lack of Jurisdiction (Doc. 41 ) is denied. IT IS FURTHER ORDERED the Motion to Quash Service of Summons and Complaint and Motion to Dismiss for Lack of Jurisdiction (Doc. 43 ) is granted in part. The Certificate of Service (Doc. 23 ) shall be quashed. If Plaintiff files an amended complaint, Plaintiff must serve the Amended Complaint and Summons on Defendant Maloney within 21 days or show cause to the Court why Maloney should not be dismissed from this lawsuit.
