Order on Motion for Extension of Time to Complete Discovery
ORDER: The Court is in receipt of Plaintiffs and Defendant Carr's motion 44 for a 30-day extension of time to complete discovery. In light of the representation that additional time is needed to reschedule Defendant Carr's deposition, the request is granted, on consent. The following deadlines are extended. Fact discovery shall be completed on or before 11/5/2026. The parties are directed to file a joint status report certifying the close of fact discovery by 11/12/2026. The status report should also include whether the parties have engaged in any settlement discussions and whether the case should be referred for mediation or a settlement conference before the Court. The last date to take the first step in dispositive motion practice is 12/4/2026, and must be done in accordance with the Individual Rules of the assigned District Judge. Given the history of the case, and the multiple discovery extensions previously granted, the parties are advised that further requests for an extension are likely to be viewed unfavorably absent extraordinary, truly unforeseen circumstances.
