Order on Motion to Withdraw as Attorney
ORDER granting 63 Motion to Withdraw as Attorney. As discussed at the status conference held on June 30, 2026: 1. The motion by Jodre Brenecki to withdraw as Plaintiff's counsel is GRANTED. (ECF 63.) The firm will not assert a charging lien. 2. On May 18, 2026, I granted the fourth request for an adjournment of the initial case management conference, (ECF 58), and I am unwilling to stay this case while Plaintiff seeks new counsel. While I am sympathetic to Plaintiff's concerns about proceeding pro se, this case was filed over a year ago, yet virtually no progress has been made; Jodre Brenecki LLP is Plaintiff's third set of lawyers, and Plaintiff's prosecution of this case cannot be postponed indefinitely while Plaintiff continues to look for new counsel. Accordingly, I will issue a separate order containing a case management plan, with the deadlines I outlined on the record. The timeframes in that plan are quite expansive for a case such as this one, and so I do not anticipate extending the discovery and other deadlines reflected in that order absent compelling circumstances. Any inability by Plaintiff to locate new counsel shall not constitute such compelling circumstances. 3. Defendant stated that it is unwilling to produce confidential documents unless Plaintiff signs a confidentiality agreement; Defendant indicated that it could provide Plaintiff with a copy of my preferred form of confidentiality agreement from the Court's website.Plaintiff indicated that she does not intend to sign any confidentiality agreement until she has located replacement counsel. I informed Plaintiff that I did not expect Defendant to produce confidential documents to her without her signing a confidentiality agreement, and that if Plaintiff cannot locate replacement counsel and does not sign a confidentiality agreement before the deadline for fact discovery, she may not be heard to complain that she was not provided with discovery by Defendant. The Clerk of Court is respectfully requested to terminate ECF 63; to terminate Nicole Brenecki and Jordan Jordre as counsel of record; and to add a pro se flag to this case, to remain on the docket until such time that Plaintiff locates replacement counsel. Plaintiff previously filed a notice of pro se appearance in this matter. (ECF 32.) SO ORDERED. Attorney Nicole Brenecki and Jordan Adam Jodre terminated. (Signed by Magistrate Judge Robyn F.
